On March 31, 2022, the Department of Labor (DOL) reported they were processing PERM PWD applications filed in October 2021 (OES) and August 2021 (non-OES).

Recall that an employer has 2 options when deciding when to begin the recruitment process.  The employer can begin advertising (1) while the PWD application is pending or (2) after the PWD is issued. Also recall that advertisements are valid for 180 days. Considering the longer processing times for PWDs (6 to 7 months), it may be best for employers to delay advertising.

In fact, the DOL reported experiencing an increase in the number of PWD applications and is encouraging employers to file their PWD applications at least 90 days, or more, in advance of the employers’ initial recruitment efforts.
