Judge Blocks Trump’s Public Charge Policy

On Friday, October 11, a federal judge in New York issued a nationwide injunction blocking the administration’s “public charge” rule that would disqualify applicants who received public benefits like Medicaid and Food Stamps.

The “public charge” rule, which was slated to take effect on Tuesday, required applicants to report the use of federal assistance and benefits, and enable USCIS officers to consider the immigrant’s use of government benefits in deciding whether to approve or deny their visa applications. Judge George Daniels of the U.S. District Court in Manhattan issued a preliminary injunction finding that those potentially affected by the new regulation could suffer “irreparable harm” if it went into effect.

As of now, USCIS is prevented from implementing the new regulation or requiring the new or updated forms in compliance with the new public charge regulation.
