USCIS Announces Premium Processing is Resumed for FY 2019 H-1B Cap Petitions

On Friday afternoon, USCIS announced it will resume premium processing beginning Monday, January 28, 2019 for Fiscal Year 2019 H-1B cap petitions. This means that if you are still waiting on a decision on a case from last year’s cap season, you can file Form I-907 with the $1,410 fee to upgrade the petition to premium processing and USCIS will adjudicate the petition within 15 days. If the petition is not adjudicated within the 15 day timeline, USCIS will refund the premium processing service fee.

USCIS also notes that the temporary suspension of premium processing is still currently in effect for all other H-1B petitions and it plans “to resume premium processing for the remaining categories of H‑1B petitions as agency workloads permit.” When USCIS begins to accept premium processing for other H-1B petitions, it will notify the public via its website.
